Specialist Leasehold Conveyancing

Leasehold Conveyancing Specialists

Buying or selling a leasehold property involves additional legal work compared with a freehold transaction. As well as the usual conveyancing process, your solicitor must carefully review the lease, investigate the management arrangements and ensure there are no issues that could affect your ownership or your mortgage lender.

At 22 Law, our experienced conveyancing solicitors act for buyers, sellers and remortgaging clients across Newcastle, Gateshead and throughout England and Wales. Whether you are purchasing your first leasehold flat or selling an apartment, we provide practical legal advice and proactive communication from instruction through to completion.

If you are looking for information about the conveyancing process generally, please visit our Residential Conveyancing page.

What Is Leasehold Conveyancing?

Leasehold conveyancing is the legal process of buying, selling or remortgaging a property that is owned under a lease. Unlike a freehold property, where ownership of both the building and the land transfers to the buyer, a leasehold property is owned for a fixed number of years under the terms of a legal lease.

The lease contains important rights and obligations that your solicitor must investigate before you become legally committed to the transaction.

What Does a Leasehold Conveyancing Solicitor Check?

Every leasehold transaction is different, but your solicitor will typically investigate:

  • The remaining term of the lease.
  • Ground rent provisions.
  • Current and historic service charges.
  • Buildings insurance arrangements.
  • The management company and managing agents.
  • Planned major works.
  • Restrictions affecting the property.
  • Any breaches of the lease.
  • Whether the lease satisfies your mortgage lender’s requirements.

Management Information Packs

One of the most common causes of delay in leasehold transactions is obtaining the management information pack. This documentation is usually supplied by the landlord or managing agents and contains important information about the building, service charges, insurance, planned works and management arrangements.

We encourage sellers to request this information as early as possible, helping to reduce delays once a buyer has been found.

Ground Rent and Service Charges

Your solicitor will review the financial obligations contained within the lease and explain anything that may affect your ownership or future costs. We also investigate whether there are any planned major works that could result in significant service charge demands after completion.

Building Safety Act

Some leasehold flats may also be affected by the Building Safety Act, particularly properties within higher-rise residential buildings. Where relevant, we will review the legal documentation available during the transaction and ensure you are aware of any implications for buyers, sellers and mortgage lenders.

You can read more on our dedicated page about the Building Safety Act.

Buying a Leasehold Property

Buying a leasehold property requires careful legal investigation before contracts are exchanged. We explain the lease in clear language, identify any potential concerns and ensure you fully understand your rights and responsibilities before committing to your purchase.

Selling a Leasehold Property

If you are selling a leasehold property, we prepare the contract documentation, obtain the management information and deal promptly with enquiries raised by the buyer’s solicitor to help keep your transaction progressing.
